Mexico · Intellectual Property

Mexican intellectual property is administered by IMPI. As a member of USMCA, the Paris Convention, PCT and the Madrid System, its protection is strengthened under USMCA (incl. patent linkage, data exclusivity). Trademark and patent squatting and counterfeiting are common in Mexico; companies are advised to file upon entry and use the stronger enforcement mechanisms under USMCA.

Key points

Procedure

  1. Trademark/patent search.
  2. Engage a local agent to file with IMPI (or enter via Madrid/PCT).
  3. Respond to examination and opposition.
  4. Maintain and monitor after grant.
  5. Record with customs to block counterfeits if necessary.

Costs

Official fees + agent fees; Madrid/PCT extra.⏱ ⏱ Timeline:Trademarks 6–12 months; patents 2–4 years.

⚠ Common risks

  • Trademark squatting leads to loss of market.
  • Counterfeits enter and go unrecorded.
  • Patent rejected for lack of novelty.
